The deceased and his wife were said to be driving from Ugbolu to Asaba when they were flagged down by the police team for search.

The defendant was said to have opened fire on the vehicle leaving the deceased dead after he was hit on the head by bullets.
The wife of the deceased who sat in the front seat with him was however, unhurt.
The Court, presided over by Justice C. D Diai convicted and sentenced defendant to death.
